§ 1-16. Fee schedule for athletic fields.

(a)

Definitions. As herein used, the following definitions shall apply:

(1)

Athletic field. A city-maintained baseball field, basketball court, football field, softball field, soccer field or tennis court located in any city park.

(2)

Organized athletic activity. Any sports activity sponsored, conducted or promoted by an established league, athletic organization or club, or activity conducted for instructional purposes, including sports clinics.

(b)

General user fees.

(1)

The general schedule of user fees, adapted and established in Appendix 1 of this Code of Ordinances, shall apply to all organized athletic activity utilizing the City of Terrell athletic fields, except for adult softball activities. The fee shall be based on the number of participants per athletic function.

(2)

Any person, group or organization wishing to utilize the City of Terrell athletic fields for organized athletic activity shall apply to the park director for permission to use such facilities and shall, as part of such application, advise the park director of the actual number of participants to take part in such activity.

(3)

Payment of the user fee shall be made at least seven days prior to the start of the athletic function, which fee is nonrefundable.

(4)

The park director may require an additional fee in the case where the user's estimated participation is less than the actual number of participants in the function.

(5)

Failure to timely provide the park director with accurate participation figures and/or failure to timely pay the user fee may result in the refusal of permission to utilize the athletic field for the particular organized athletic activity.

(6)

All user fees so collected shall be deposited into a revenue account maintained for each separate athletic facility for expenditure for facility improvements in the fiscal year next following collection of such funds.

(c)

Adult softball user fees.

(1)

The schedule of user fees, adopted and established in Appendix 1 of this Code of Ordinances, shall apply to all organized adult athletic activity utilizing the City of Terrell softball fields.

(2)

Payment of the user fee shall be made at least seven days prior to the start of the adult softball athletic function, which fee is nonrefundable.

(3)

Failure to timely pay the user fee may result in the refusal of permission to utilize the softball field for the particular organized athletic activity.
