§ 9-9. Civil service classification plan; longevity pay.

  • (a)

    Classification of firefighters. Firefighters of the city fire department are classified as follows, and the number of positions of each classification thereof are as follows, with the salary per position as stated adjacent to each classification:

    (2)

    Each police officer as classified herein has civil service protection, upon completion of a one-year probationary period upon hire. A classified position may be filled only from an eligibility list that results from an examination held in accordance with V.T.C.A., Local Government Code ch. 143.

    (c)

    Longevity pay. In addition to such salaries, any person performing the duties of said classification shall be paid an additional sum per month as set by state law for each year of service in the city fire department or police department up to and including all years of service in said department.

    (d)

    Sick time.

    (1)

    A firefighter or police officer, whose appointment is in substantial compliance V.T.C.A., Government Code ch. 143, is allowed sick leave with pay accumulated at a rate of 1¼ full working days for each full month employed in a calendar year, so as to total 15 working days to a persons credit each 12 months.

    (2)

    A firefighter or police officer may accumulate sick leave without limit and may use the sick leave if unable to work because of a bona fide illness.

    (3)

    A firefighter or police officer who leaves the classified service for any reason is entitled to receive a lump sum payment in the full amount of the persons salary for the accumulated sick leave if the person has accumulated not more than 90 days of sick leave. If the fire fighter or police officer has more than 90 working days of sick leave, the city shall limit payment to the amount that the person would have received if the person had been allowed to use the 90 days of accumulated sick leave during the last six months of their employment. For the purposes of determining the lump sum payment, each accumulated sick day is considered to be a shift, as defined by state law.
