§ 1-23. Smoking regulations.

  • (a)

    Prohibition. Smoking, defined as the lighting, holding or carrying of, or emitting or exhaling the smoke of, a pipe, cigar or cigarette or any kind, is unlawful in the following City of Terrell facilities:

    Terrell Municipal Center—201 E. Nash Street

    Terrell Public Library—311 N. Rockwall

    Terrell Municipal Service Center—Airport Road

    Terrell Sanitary Landfill—Flowers Lane

    Terrell Community Services Center—115 N. Adelaide

    Terrell Water Pollution Control Plant—Mt. Hebron Road

    Terrell Water Treatment Plant—Highway 80 East

    Terrell Swimming Pool Facility—Ben Gill Park

    Terrell Park Department Buildings—Ben Gill Park

    Terrell Public Safety Facility—225 Baker Street

    Terrell Municipal Airport—Airport Road

    Robert Stout Memorial Police Training Center—Griffith

    (b)

    Prohibition—Vehicles. Smoking, defined as the lighting, holding or carrying of, or emitting or exhaling the smoke of, a pipe, cigar or cigarette of any kind, is unlawful in city-owned vehicles.

    (c)

    Violation and penalty.

    (1)

    A person commits an offense if:

    a.

    At any of the facilities listed in subsection (b) or in any city-owned vehicle the person smokes as defined in subsection (a) herein.

    b.

    He or she willfully destroys or defaces a sign posted or required by this section.

    (2)

    The responsibility for administering and enforcing this section shall be that of the city manager and/or department head in charge of a facility or vehicle, but nothing herein shall prevent any other person from filing a complaint or reporting a violation hereof.

    (d)

    Signs. The city manager and/or department head in charge of a facility shall place signs visible at each public entrance to the premises to notify persons entering the premises that smoking is prohibited. This provision does not include exists used exclusively as emergency exits.
