§ 9.01. Municipal Elections.

  • (a)

    Regular Elections. Regular elections shall be held annually in accordance with the Uniform Election Code.

    (b)

    Qualified Voters. All citizens qualified by the Constitution and laws of the State of Texas to vote in the city, and who satisfy the requirements for registration prescribed by law shall be qualified voters of the city within the meaning of this charter, provided that the citizen must have resided inside the corporate limit of the City of Terrell for at least a thirty (30) day period prior to any election.

    (c)

    Conduct of Elections. The provisions of the Election Code of the State of Texas shall apply to elections held under this charter except when the Election Code gives precedence to the home rule charter. All elections provided for by the charter shall be conducted by the election authorities established by law. For the conduct of city elections for the prevention of fraud in such elections, and for the recount of ballots in cases of doubt or fraud, the council shall adopt by ordinance all regulations which it considers desirable, consistent with law and this charter.

    Special Elections. The council may by ordinance order a special election, fix the time for holding same, and provide all means for holding such special election which shall be held in accordance with the Uniform Election Code.

    Failure to Act. In the case of the failure of the council to act, the election may be ordered by the city secretary, and, in case of his failure to act, by the county judge of Kaufman County, Texas, and, in case of his failure to act, by Governor of the State of Texas. The city secretary shall give notice of such election by causing said notice to be published and posted not less than ten (10) or more than thirty (30) days previous to the day of such election in the official newspaper of the city.
